Privacy policy
1. Controller
The controller is ModeWerk by Franziska Gögele, Am Mühlbach 3, 39020 Glurns (BZ), Italy, email info@modewerk.it, certified email (PEC) franziskagoegele@pec.bz.it.
2. Data we process
Depending on how the shop is used, we process identity and contact details, delivery and billing addresses, order and payment information, account and communication data, voucher and return data, and technical data such as IP address, time, browser, device and logs. ModeWerk does not store full card details or PayPal credentials.
3. Purposes and legal bases
- Orders and accounts: performance of a contract and pre-contractual steps.
- Payment, delivery, returns and service: contract performance and legal obligations.
- Accounting and retention: compliance with tax and commercial-law duties.
- Security and abuse prevention: legitimate interest in a secure and functional shop.
- Newsletters and non-essential cookies: consent, which can be withdrawn for the future at any time.
4. Recipients and providers
Data is disclosed only to parties that need it for the relevant purpose, such as IT and hosting providers, payment providers, banks, carriers, email and newsletter services, support providers, tax advisers and authorities.
Depending on selection or consent, these include Hetzner for hosting, LP Bartolini for delivery, PayPal/PrestaShop Checkout and Mollie for payments, Brevo for newsletters, Tawk.to for chat, and Google services for consent, security or analytics. Their privacy notices also apply. Non-essential analytics or marketing services may be activated only after consent.
5. Transfers outside the EEA
Some providers may process data outside the European Economic Area. Transfers take place only on a valid basis, such as an adequacy decision or appropriate safeguards including EU standard contractual clauses. Where consent is required, a transfer takes place only after consent.
6. Retention
Data is retained only as long as necessary. Contract, invoice and accounting records are generally retained for up to ten years as required by law. Accounts remain until deletion unless retention duties apply. Enquiries are deleted after completion and expiry of relevant periods; consent records are kept as long as necessary for evidence.
7. Newsletter
Newsletters are sent only with consent, and a confirmation process may be used. You can unsubscribe at any time using the email link or by contacting info@modewerk.it.
8. Cookies
Technical cookies provide the site, basket, login, language and security functions. Analytics, convenience and marketing technologies are used according to the choice made in the consent panel. The choice can be changed at any time. Details are in the Cookie policy.
9. Your rights
Subject to the GDPR’s conditions, you have rights of access, rectification, erasure, restriction, portability and objection, and may withdraw consent for the future. Contact info@modewerk.it. You may also lodge a complaint with the Italian Data Protection Authority or another competent supervisory authority.
10. Required data and automated decisions
Without data required for ordering, payment and delivery, the contract cannot be performed. ModeWerk does not make decisions based solely on automated processing that produce legal or similarly significant effects.
11. Security and updates
We use appropriate technical and organisational safeguards, including encrypted transmission. This policy may be updated when services or legal requirements change.
