Terms and conditions
1. Scope and seller
These terms apply to orders placed at www.modewerk.it. The seller is ModeWerk by Franziska Gögele, Am Mühlbach 3, 39020 Glurns (BZ), Italy, VAT No. IT 02865350215. A consumer is a natural person acting for purposes outside their trade, business, craft or profession.
2. Offer and conclusion of contract
Products displayed in the shop do not constitute a binding offer. By clicking the final order button, the customer submits a binding offer for the goods in the basket. The automated order confirmation only records receipt. The contract is concluded when ModeWerk expressly accepts the order, dispatches the goods or confirms that they are ready for collection.
If an item is unavailable despite careful stock management, we will inform the customer promptly and refund payments already made to the original payment method.
3. Prices and shipping costs
All prices are final prices in euros and include statutory VAT. Shipping costs are clearly displayed before the order is submitted. Shipping is free on orders of at least €50.00. Details are provided under “Shipping & payment”.
4. Payment
The payment methods displayed during checkout are available, including methods offered through Mollie or PrestaShop Checkout, PayPal and bank transfer. The terms of the selected payment provider also apply. Bank-transfer orders are processed after funds are received.
5. Delivery and collection
We deliver to the countries and addresses available during checkout. Costs and estimated delivery times are shown before ordering. Collection from the offered ModeWerk stores is free; customers are notified when their order is ready.
Partial deliveries are permitted where reasonable and do not result in extra costs. For consumers, the risk of accidental loss passes only when the goods are delivered to the customer or a third party designated by them other than the carrier.
6. Retention of title
Goods remain the property of ModeWerk until paid for in full.
7. Right of withdrawal
Consumers generally have a statutory 14-day right of withdrawal for online purchases. Details, exceptions and the model form are provided under “Withdrawal & returns”.
8. Legal guarantee
The legal guarantee of conformity under Italian consumer law applies. ModeWerk is generally liable to consumers for lack of conformity appearing within two years after delivery. Within the statutory conditions, the consumer may initially request repair or replacement and, where applicable, a price reduction or termination. Manufacturer warranties do not restrict statutory rights.
9. Liability
ModeWerk has unlimited liability for intent, gross negligence, and injury to life, body or health. Otherwise, statutory liability rules apply. Mandatory consumer rights and product-liability claims remain unaffected.
10. Gift vouchers
Vouchers may be redeemed within their stated scope and up to the available balance. Cash payment is excluded to the extent permitted by law. If a voucher code not blocked to a named person is lost, ModeWerk cannot guarantee replacement without proof of the remaining balance.
11. Applicable law
Italian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of the consumer’s country of habitual residence and the consumer’s statutory jurisdiction remain unaffected.
12. Contact and disputes
Questions and complaints may be sent to info@modewerk.it. The former EU ODR platform has been discontinued, so no obsolete link is provided. Information on recognised ADR bodies is available from the Italian Ministry of Enterprises and Made in Italy.
